The first part examines, especially with regard to Gottfried Wilhelm Leibniz, how the concept of presumption was extracted from the legal doctrine of evidence and generalised and further developed for general epistemology and methodology. In the second part, selected examples from the 17th and 18th centuries are used to show how the concepts of presumption and presumption rule have been applied in hermeneutics to specify and systematise the hermeneutical rules that have been handed down. I will conclude with an appeal to German-speaking lawyers. [ABSTRACT FROM AUTHOR]
La première partie examine, notamment en ce qui concerne Gottfried Wilhelm Leibniz, comment le concept de présomption a été extrait de la doctrine juridique de la preuve, puis généralisé et développé pour l'épistémologie et la méthodologie générales. Dans la deuxième partie, des exemples choisis des XVIIe et XIIIe siècles sont utilisés pour montrer comment les concepts de présomption et de règle de présomption ont été appliqués en herméneutique pour spécifier et systématiser les règles herméneutiques qui ont été transmises.
