After the implementation of the South Tyrol Package (SOdtirol-Paket) and Austria's declaration of settlement before the UN in 1992, and especially after the constitutional reform of 2001, has South Tyrol autonomy made progress or suffered setbacks? This controversial question was the focus of my remarks at the joint conference of professors from the Universities of Bolzano-Bozen, Trento and Innsbruck, on the commemoration of the 50th anniversary of the entry into force of the new Statute of Autonomy. In fact, after the constitutional reform of 2001, the Roman Constitutional Court (Corte Costituzionale) considerably restricted various competences. On the other hand, many new areas were transferred to the country that go beyond the new Statute of Autonomy of 1972. The challenge of this work is to contrast the extensions and their quality with the curtailments of autonomy and to draw a balance. We focus on the highest and thus most important legal sources that regulate autonomous life: the Italian Constitution (Vf), the Statute of Autonomy (AuSt), which has constitutional status, and the corresponding constitutional laws. They can be amended only with an aggravated procedure, two readings by both chambers of parliament and an absolute majority, and thus form a solid foundation of autonomy. [ABSTRACT FROM AUTHOR]
Hat die SOdtirol-Autonomie, nachdem das SOdtirol-Paket durchgefOhrt war und Osterreich vor der Uno im Jahre 1992 die Streitbeilegung erkIArt hatte, im Besonderen nach der Verfassungsreform 2001, Fortschritte erzielt oder RuckschIAge erleiden mussen? Diese umstrittene Frage stand im Mittelpunkt meiner Ausfuhrungen bei der gemeinsamen Tagung von Professoren der UniversitAten Bozen, Trient und Innsbruck, anldsslich des Gedenkens des 50. Jahres des Inkrafttretens des neuen Autonomiestatutes.8 Tatsdchlich hat der romische Verfassungsgerichtshof (VfGH) nach der Verfassungsreform von 2001 verschiedene ZustAndigkeiten erheblich eingeschrAnkt. Auf der anderen Seite gingen ans Land viele neue Bereiche Ober, die Ober das neue Autonomiestatutvon 1972 hinausreichen. Die Herausforderung dieser Arbeit besteht darin, die Erweiterungen und deren Qualitdt den Beschneidungen der Autonomie gegenuberzustellen und eine Bilanz zu ziehen. Dabel konzentrieren wir uns auf die hdchsten und damit wichtigsten Rechtsquellen, die das autonome Leben regeln: die italienische Verfassung (Vf), das auf Verfassungsrang stehende Autonomiestatut (AuSt) und die entsprechenden Verfassungsgesetze. Diese k6nnen nur mit einem erschwerten Verfahren, zweimaliger Lesung von beiden Parlamentskammern sowie absoluter Mehrheit abgedndert werden und bilden somit ein solides Fundament der Autonomie.
