The article deals with the teleological reduction of § 3c para. 2 EStG with regard to interest payments for "intra-group" loans. It is stated that § 3c para. 2 EStG is not applicable to operating expenses of the partnership, but only to special remuneration of the shareholders. In the case of multi-tiered partnerships or consolidated groups, the consideration of § 3c para. 2 EStG is limited to the overall profit of the specific partnership. The case relates to interest expenses in connection with the acquisition of shares in D-GmbH and the plaintiff 1 is a general partnership. It concerns a tax dispute regarding special business profits and special business expenses. The tax court (FG) has allowed some lawsuits, while others have been considered inadmissible. The Federal Fiscal Court (BFH) has overturned the FG's judgment and referred the matter back. Der Artikel behandelt die teleologische Reduktion des § 3c Abs. 2 EStG in Bezug auf Zinszahlungen für "unternehmensgruppeninterne" Darlehen. Es wird festgestellt, dass § 3c Abs. 2 EStG nicht auf Betriebsausgaben der Gesamthand anwendbar ist, sondern nur auf Sondervergütungen der Gesellschafter. Bei mehrstöckigen Personengesellschaften oder Organschaften bleibt die Betrachtung des § 3c Abs. 2 EStG auf den Gesamtgewinn der konkreten Mitunternehmerschaft beschränkt. Der Sachverhalt bezieht sich auf Schuldzinsen im Zusammenhang mit dem Erwerb von Anteilen an der D-GmbH und die Klägerin zu 1. ist eine KG. Es geht um eine steuerliche Auseinandersetzung bezüglich Sonderbetriebsgewinnen und Sonderbetriebsausgaben. Eine teleologische Reduktion des § 3c Abs. 2 EStG ist sowohl bei Zinszahlungen des Mitunternehmers an die Gesellschaft als auch umgekehrt geboten. Die Sonderbetriebsausgaben, die aus an die Klägerin gezahlten Zinsen resultieren, sind nicht gemäß § 3c Abs. 2 EStG zu kürzen. Die Revision des Finanzamts in Bezug auf die von der Klägerin gezahlten Darlehenszinsen ist jedoch begründet, da diese dem Abzugsverbot des § 3c Abs. 2 EStG unterliegen. Es geht um eine steuerrechtliche Entscheidung des Bundesfinanzhofs (BFH) bezüglich der Zurechnung von Einkommen und Aufwendungen bei einer Organträger-Personengesellschaft. Es wird festgestellt, dass das Einkommen der Organgesellschaft dem Organträger zuzurechnen ist und dass die Zinsaufwendungen der Organgesellschaft ebenfalls dem Abzugsverbot unterliegen.
